Woman on NYC Train Continued to Push Dog

Great debate, thank you for the input. Very interesting to say the least. My view was that if my kid accidentally brushed up against a lady would it give her the right to push my kid and to me it was a no. No service dog or any dog is perfect and no human is perfect, a brush up is bound to happen, slight rules will be broken on occasion but nobody has the right to hit first. I respect everyones opinion so thanks
But this isnt about a kid or an accidental brush. Most people are just looking at it from the info that is provided from the news stories.

The person that filmed the incident said that the dog was sitting on the bench.

"Kyng said the man sat down and put his dog on the seat, and as the dog lay down, it bumped the female passenger.

"She was like, 'The dog don't belong on the seat, that's an animal, people belong on the seat, put the dog on the floor,'" Kyng said. "And he looked at her like, I'm not moving my (expletive) dog.'"

From there, it went downhill quickly. Kyng said the woman first pushed the dog off the seat. The owner put him back up, and she shoved the dog off again. The owner responded with fists."

Both people were in the wrong, but this wouldn't have happened if the dog had been where it was supposed to be. By law, if it was a service animal.

Wow, she really was a loony bird. Pushed the dog off the seat as it was nicely laying down. This dog was not aggressive at all.

Yes it was, the dog was laying down from Boxergirls filming witness. The nutcase then proceeded to say that dogs weren't humans and pushed the dog while it was laying down off the seat. Yikes!

At the end of the day this dogs life may now be at risk because of this.... My worst nightmare is Bella biting someone no matter the reason.... I could be ordered to euthanize her.... I believe no matter if she's trying to protect me or not...I'm reasonably for my dogs actions

Or even if she bites another animal. Scary for us. I sure hope the judge see's this my way.

Did you not read the part where he kept putting the dog on the seat by her after that? He sounds just as insane.

I think his blood boiled when the woman pushed the calm nice dog off the seat. You do know the dog did not injure this woman in any way? It was the first push that mattered and will matter in court.

It doesn't matter what we think or guess. Her blood obviously boiled when the dog touched her and when the dog was illegally on the seat. Which happened 1st. The court isn't going to ignore the fact that the dog legally was not allowed on the seat. Obviously the law didn't which is why he was charged.

I don't know that. Unless she made a statement saying so I dont think anyone can say know. Im not into speculating.

Great news if she wasn't. Gives the dog a better chance.

Steven, service dogs are expected to remain on the floor. He should never have been on the seat in the first place. There are rules that must be followed. I don't understand why you seem to feel that this man was an exception to the rules set forth by the ADA.

Nobody is an exception to the rules. Breaking the rules such as this does not allow anyone to hit or push a dog off the seat. The judge will see it my way I'm sure. At most the lady could have asked to remove the dog from the seat, if he declined she had to accept that and either a. move or b. stay next to the dog. Not push the dog off, she had no right to became physical. My entire argument. I am not siding with anyone. I am stating the facts that I have read and I stop when she became physical. I feared for the dogs life, she could have stabbed the dog. Him on the other hand being wrong also, deserved a ticket or an infraction or warning.

Why should she have had to move when he was breaking the rule? I'm not saying her physical actions were warranted. They weren't. I'm saying that this didn't have to happen and wouldn't have happened if he had followed the rules in the first place. His behavior would have justified his being asked to leave in any other establishment. What right did he have to put the dog on the seat? None. He did not follow the law and he did NOT put his dog's interests before his own. Shame on him. The dog deserves a handler that will put his safety before the owner's desire to do whatever he wants.

Despite the "who acted first and why", both parties did have multiple chances to act in a de-escalating way. Should the dog have been on the seat? No. Could she have moved? Yes. I‘m not saying the owner was right, but one can never know what agendas someone follows. She might have had a Pitbull bias (who knows). At the same time, he shouldn‘t have placed the dog back on the seat. Maybe it was his attention to provoce and make sure he gets what he thinks is right. To me the question really is: is it worth taking all that risk for an unnecessary situation like that? The owner gets his dog in danger, and she runs the risk of getting bitten. I wouldn‘t take either risk if I were them. All I‘m trying to say is that both should have prevented this situation from escalating. And, no, this doesn‘t mean that one party has to tolerate everything the other party does, but if it stops a stupid situation from turning into something really bad, why not finding alternative options.

Ive already have lost a dog because of biting....he was a king shepherd..... He would follow me to school everyday, then go home...at the end of school he would be waiting for me.... My parents tried to contain him, but he was a escape artist....
One day in my own driveway I was attacked by 3 boys...bullies .... My dog was tied out back with a choke chain....he could see me and these 3 boys .....I'll never forget it ....while 2 of the hem held me down while another punched me in the face....I seen my dog jump straight up and when he came down the choke chain was off.... As he came running towards me the boys holding me seen him and took off.... The other boy didn't get away as fast as the other 2.... Monty my dog nailed him in the foot... Bit right threw the kids cowboy boot..... I called the dog to me and he came right back to my side...he didn't even leave our property ... Barely broke the skin....but did leave a scratch on the kids heel.... Of course it was my word against the 3 boys..... The father said if we destroyed the dog he wouldn't sue my parents.... I lost my best friend that day.... It's a hard lesson for an 8 yr old to learn

I think I have such an issue with the dog owner's behavior because he is claiming that his dog is a service dog. Disregarding the rules as if he is a special cupcake puts the rights of other service teams at risk. Service teams that go above and beyond, even at their own inconvenience, to follow the rules. It makes everything more difficult for people that have enough difficulties in their lives already.

Terrible story. I would not wish having to put down a hero dog to stop a lawsuit on anyone.

I see what you mean. But its hard to know all the exact rules. Millions of drivers to this day do not know the left lane is the passing lane and ride even mopeds at 30mph in a 50 which is illegal. I'm not saying he is right at all, I am saying perhaps he didn't know the seat rule. Just to be clear even if he was just being an idiot which is entirely possible, she should never get physical without fear of retaliation. I never heard of that rule. Either way, I will surely update this case as its heard to see what happens.

Sorry, but I disagree. If you have a service animal then you'd better know the rules. Ignorance is no excuse. I've posted the laws repeatedly. I've posted FAQs that cover just about every single question that someone could have. The information is easy to find for anyone that cares to take a minute to look. It's the owner/handler's responsibility. You haven't heard of the rule because you don't own a service dog. I bet if you did you'd educate yourself so you could keep your animal safe.

I'm going to be watching this too. I hope the only one that doesn't get in trouble is the dog.

So since all drivers should know the rules too and I agree, maybe we should all pull a Baldazano in NJ on them, he did 6 months for this.

To me its more than the law. Its common sense and respect for strangers and other people too.
I can' put my love for dogs above respecting my fellow citizens.

The dog doesn't belong where people are sitting whether its illegal or not. Seats are for paying customers.
People have allergies
People have germ issues
People dont want shedding
People dont want slobber
And people dont know your health records or hygiene of your dog. They may not want to bring something home to their animals.
Why cant people be considerate?

If you blatantly disrespect another human being, whether its right or wrong things can very easily get physical.

Where im from I would automatically expect things to turn physical if I blantly disrespected somebody.

He totally disrespected and disregarded the law and her request to move the dog before the situation became physical.
To me I have no idea how that part is glossed over.

What happens next is equally as wrong.

If the incident was about him not wanting his dog to be hit, he would of never kept putting his dog up on the seat repeatedly. That is not the action of somebody who doesn't want their dog to get shoved.

Exactly!, and as TylerDruden mentioned, there were LOTS of opportunities for both sides to DEESCALATE this, but instead, the lady put HERSELF, and the dude put his DOG in danger. I blame the lady for being inconsiderate, I blame the dude for being an ASSHOLE.

I think everyone's lucky this didn't turn into a bloody mess with these two individuals in the middle.
